Fresh.dev Terms of Service

1. Introduction

Welcome to Fresh.dev. These Terms of Service (“TOS”) govern your access to and use of Fresh.dev’s websites, platforms, APIs, infrastructure, and related services.

This TOS is a legally binding agreement between you and Fresh.dev Ltd, a company incorporated in the United Kingdom.

2. Definitions

  • “Fresh.dev”, “we”, “us”, “our” means Fresh.dev Ltd and its affiliates.
  • “User”, “you”, “your” means the individual or legal entity using the Websites or Services.
  • “Websites” means https://fresh.dev and related domains.
  • “Services” means all Fresh.dev services including compute, storage, managed services, DNS/domains, AI services, APIs, and marketplace offerings.
  • “Services Content” means all data, code, configurations, files, prompts, datasets, outputs, and other materials you upload to or process through the Services.
  • “End Users” means third parties who access your Services Content through applications you operate.
  • “AUP” means our Acceptable Use Policy, incorporated by reference.
  • “DPA” means our Data Processing Agreement, incorporated by reference.

3. Acceptance and Eligibility

3.1 Binding agreement

By accessing or using the Websites or Services, you confirm that you have read, understood, and agree to be bound by this TOS.

3.2 Age and authority

You must be at least 18 years old. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.

3.3 Legal compliance

You may only use the Services in compliance with all applicable laws and regulations.

4. Account Registration

4.1 Accounts

Access to Services requires an account. You must provide accurate, complete, and up-to-date information.

4.2 Security

You are responsible for safeguarding credentials, API keys, SSH keys, and access tokens. You are liable for all activity on your account.

5. Services Overview

Fresh.dev provides:

  • Compute Services (Virtual Machines, networking, IPs)
  • Storage Services (Object storage, block storage, snapshots, backups)
  • Managed Services (Managed PostgreSQL, Managed Airflow/workflows)
  • Domains & DNS
  • AI / Model Training & Inference APIs
  • Marketplace / Add-ons

6. PAYG Billing, Payments, and Taxes

6.1 Pay-As-You-Go billing

Fresh.dev operates on a pay-as-you-go (PAYG) basis. You are billed in arrears for actual usage of compute, storage, networking, AI workloads, and other metered resources.

Invoices are typically issued monthly.

6.2 Payment methods

You must maintain a valid payment method on file. We may suspend or terminate Services if payment fails or remains outstanding.

6.3 Usage measurement

Usage is measured by our systems and considered authoritative unless shown to be materially incorrect.

6.4 Taxes (UK VAT)

Prices exclude VAT unless stated otherwise. VAT will be charged where applicable unless you provide a valid VAT registration number supporting reverse-charge treatment.

6.5 Credits

Promotional or service credits may be offered at our discretion and may expire or be revoked. Credits have no cash value.

7. Acceptable Use & Zero-Tolerance Policy

7.1 General obligation

You must comply with the Acceptable Use Policy (AUP) at all times.

7.2 Strictly prohibited activities

You may not, directly or indirectly:

  • Run cryptocurrency mining, staking, or proof-of-work workloads
  • Operate TOR nodes, TOR relays, TOR exit nodes, or anonymisation gateways
  • Operate VPN resale, open proxies, relay networks, or traffic-laundering services
  • Host or distribute malware, botnets, phishing infrastructure, or exploit kits
  • Conduct DDoS attacks, port scanning, or network abuse
  • Host or distribute illegal content of any kind

7.3 Zero-tolerance for illegal content

Fresh.dev has zero tolerance for illegal content.

If we detect or reasonably suspect illegal content or activity, including (but not limited to):

  • Child sexual abuse material (CSAM)
  • Terrorist content
  • Illegal drugs or weapons distribution
  • Human trafficking or exploitation material

We may immediately suspend or terminate your account without notice, preserve relevant data, and notify law enforcement or relevant authorities as required or permitted by law.

8. Service-Specific Terms

8.1 Compute Services (Virtual Machines)

  • You are responsible for OS configuration, patching, security, and applications.
  • VM local or ephemeral disks may be lost during failure or rebuild.
  • IP addresses may change or be reclaimed for operational or legal reasons.
  • Compromised or abusive VMs may be suspended immediately.

8.2 Storage Services

  • You control access, encryption, lifecycle policies, and data retention.
  • Deleting storage resources may be irreversible.
  • Snapshots and backups (if offered) are not a substitute for your own backup strategy.

8.3 Managed Databases (Postgres)

  • We manage infrastructure and baseline operations.
  • You remain responsible for schema design, queries, data correctness, and access control.
  • Backups and PITR retention are plan-dependent.
  • Maintenance windows and emergency patches may occur.

8.4 Managed Workflows (Airflow / Orchestration)

  • You are responsible for DAG code, job logic, secrets, and side effects.
  • Tasks may run in ephemeral environments.
  • Usage limits and concurrency controls may apply.

8.5 Domains & DNS

  • You must provide accurate registrant information.
  • DNS propagation depends on TTLs and third-party resolvers.
  • We may suspend zones or domains for abuse, disputes, or legal compliance.

8.6 AI / Model Training & Inference Services

  • Inputs, datasets, prompts, and outputs are your Services Content.
  • Outputs may be inaccurate or non-unique; you must validate before use.
  • You must have rights to all training data.
  • AI Services must not be used for unlawful profiling, discrimination, or safety-critical decisions without explicit written agreement.
  • Abuse detection systems may monitor for prohibited or illegal usage.

8.7 Marketplace / Add-ons

  • Vendor offerings are Third-Party Services unless stated otherwise.
  • Vendor terms may apply.
  • Billing and support responsibilities may vary by listing.

9. Data Protection

Where Fresh.dev processes personal data on your behalf, the Data Processing Agreement (DPA) applies. You are responsible for ensuring lawful processing and appropriate notices to End Users.

10. Confidentiality & Beta Services

  • Confidential information must be protected.
  • Beta or experimental services are provided “as is” with no SLA.
  • Beta services may be modified or withdrawn at any time.

11. No Warranty

To the fullest extent permitted by law, the Websites and Services are provided “as is” and “as available” without warranties of any kind.

12. Limitation of Liability

12.1 Excluded damages

We are not liable for indirect, incidental, special, or consequential damages.

12.2 Liability cap

Our total liability is limited to the amount you paid to Fresh.dev for the affected Services in the one (1) month preceding the event giving rise to the claim.

12.3 Non-excludable rights

Nothing limits liability that cannot be excluded under UK law.

13. Indemnification

You agree to indemnify and hold harmless Fresh.dev from claims arising out of:

  • Your Services Content
  • Your End Users
  • Breach of this TOS or law
  • Illegal or abusive activity conducted via your account

14. Termination

We may suspend or terminate Services immediately for:

  • AUP violations
  • Illegal activity
  • Non-payment
  • Security threats
  • Legal or regulatory requirements

Termination may result in loss of access to data. Fees remain payable.

15. Governing Law & Jurisdiction

This TOS is governed by the laws of England and Wales.

The courts of England and Wales have exclusive jurisdiction, subject to mandatory consumer protections.

16. Miscellaneous

  • We may update this TOS from time to time.
  • Continued use after updates constitutes acceptance.
  • This TOS is the entire agreement unless superseded by a signed written contract.
  • The parties are independent contractors.
  • Force majeure events excuse non-performance.
